Terms & Conditions for Hospitals
In accordance with the Information Technology Act of 2000, its rules, and the revised sections of
several legislation pertaining to electronic records as amended by the Act, this document is an
electronic record. A computer system created this electronic document; no digital or physical
signatures are needed.
The information in this document complies with Rule 3 (1) of the Information Technology
(Intermediaries guidelines) Rules, 2011, which mandates the publication of the terms of use,
privacy statement, and rules and regulations for using the
www.medtotes.com website and its mobile applications.
Medtotes Platform
Medtotes Pvt Ltd. (hereinafter referred to as "Medtotes"), a company incorporated under
the provisions of the Companies Act, 2013, which operates
www.medtotes.com , an Internet-based portal Website and "Medtotes" a mobile
application (hence collectively referred to as the "Platform").
In these Terms of Use, "Service Provider" refers to a entity involved in offering various
services, including but not limited to connecting users with qualified healthcare professionals,
nurses, physiotherapists, trained attendants, licensed retail pharmacies, diagnostics, and
similar services.
In these Terms of Use,” Crew” refers to all members of the Service Provider, like but not
limited to Doctors, Nurse, Physiotherapists, Trained Attendant.
The Service Provider agrees to render the service to the Users. Medtotes and its Platform serve
as a facilitator, connecting the User with the Service Provider through technology.
Medtotes is not responsible for delivering products purchased by the User or providing services
outside of India.
By using this Platform or any Medtotes facility or service, the Service Provider agrees to be
bound by these Terms. This includes reading, understanding, and agreeing to comply with these
Terms, as well as any relevant rules, guidelines, policies, and conditions under applicable
law(s) in India.
Service Providers are obligated to the following:
- It shall be the sole responsibility of the Service Provider to ensure its Crew members
Qualifications/Accreditations are duly verified in a timely manner and found eligible for
the role. Medtotes has no responsibility or liability and will play no role with the Service
Provider in this regard.
- The Roles and Responsibilities of the Crew members shall be duly defined by the Service
Provider at its discretion. Medtotes shall play no role in this regard.
- The terms governing the arrangement or partnership between the Service Provider and Medtotes
shall be available in a separate Agreement, which mutually agreed upon by both the parties
and liable.
- The Service Provider shall be solely responsible for the safety and security of its crew
member at the time of rendering of services at the User’s premises.
- The Service Provider shall ensure the presence of a caretaker/ family member of the User
during the entire period of rendering of services at the User’s premises.
- The Service Provider shall provide all applicable documents i.e. Registration Certificate,
Municipal registration, labour licence, GST Number, Photograph of the building showing sign
board and any other supporting document(s) as required by Medtotes, before the Service
Provider onboards the platform.
- In case the Service Provider’s crew has any questions or uncertainties regarding the
treatment or physiotherapy recommended by the prescribed doctor, the Crew should clarify the
same by the prescribed doctor for clarification. If the Crew is uncertain on the treatment
or physiotherapy it is the responsibility of the Service Provider to arrange a
guidance/training/clarification by the domain/subject matter experts.
- The Service Provider shall notify the Medtotes electronically upon service Delivery or
non-Delivery through the Platform features within the specified time frame in these Terms of
Use. Failure to notify after non- rendered services, requires a valid reason within
specified time. Medtotes reserves the right to take necessary actions in response.
- Service Provider shall notify the User promptly if the assigned Crew is unavailable due to
an emergency, it is the Service Provider responsibility to arrange substitute Crew and
inform the User in timely manner.
- Service Provider ensures that the qualified/ specialized Crew attends the User as per the
booking requirements of the User and that specialized Crew is not substituted/ replaced
under any circumstances. In case if the Crew need to be changed then the Service Provider
should arrange a substitute with equal qualifications. If the Service Provider unable to
arrange a substitute with equal qualifications, should notify to user in written and arrange
available substitute with an agreement with the User. In case of failing any of the above
conditions Medtotes has right to send a Notice or Termination depending on the severity.
- The Service Provider is expressly prohibited from transmitting any promotional messages,
emails, or other forms of communication containing personal content, Promotional content,
Marketing content except those directly related to the provision of services to the users.
- The Service Provider is obligated to uphold the privacy of patient/User details during and
after the services are rendered and shall abide by the Medtotes Privacy Policy to maintain
the privacy of the user information.
The Service Provider acknowledge that Medtotes will not be liable for any damages, interests or
claims etc. resulting from not processing a transaction and/or transaction price or any delay in
processing a transaction and/or transaction price which is beyond control of Medtotes.
Note : All Terms and Conditions, Privacy Policy applicable to users are equally
binding for Service Providers.
Terms & Conditions for Diagnostics
The Service Provider agrees to render the service to the Users. Medtotes and its Platform serve
as a facilitator, connecting the User with the Service Provider through technology.
Medtotes is not responsible for delivering products purchased by the User or providing services
outside of India.
By using this Platform or any Medtotes facility or service, the Service Provider agrees to be
bound by these Terms. This includes reading, understanding, and agreeing to comply with these
Terms, as well as any relevant rules, guidelines, policies, and conditions under applicable
law(s) in India.
Service Providers i.e. Diagnostics are obligated to the following :
- The Service Provider shall ensure that all diagnostic tests are conducted strictly in
accordance with the prescriptions issued by licensed medical practitioners. The Service
Provider is required to maintain comprehensive and verifiable documentation as evidence of
adherence to the prescribed diagnostic protocols.
- Service Provider may also be required to provide home services on demand either free or on
chargeable basis, as applicable on case-to-case basis
- The Service Provider shall be liable for any inaccuracies in testing or report generation
that may result in incorrect treatment or mental distress for the patient.
- It is the responsibility of the Service Provider to send a qualified Crew for the sample
collection. Before sample collection the Crew shall guide the User regarding sample
collection procedures, including providing clear instructions on the collection process,
specifying the required steps to be taken, and explaining the anticipated time frame for
obtaining test results. Additionally, offer comprehensive information on any specific
preparation or considerations before the services, ensuring the User is well-informed and
adequately prepared for the upcoming procedures.
- The Service Provider or Phlebotomist shall maintain stringent hygiene during sample
collection for accurate results and prevents contamination of the sample and ensure the
safety for both Service Provider/ Phlebotomist and Users. This involves prioritizing hand
hygiene, wearing necessary PPE like gloves and masks, using sterile equipment, and adhering
to proper transportation and storage protocols for collected samples.
- The Service Provider is obligated to deliver reports to the User in timely manner.
- The Service Provider is obligated to uphold the privacy of patient/User details during and
after the services are rendered and shall abide by the Medtotes Privacy Policy to maintain
the privacy of the user information.
The Service Provider acknowledge that Medtotes will not be liable for any damages, interests or
claims etc. resulting from not processing a transaction and/or transaction price or any delay in
processing a transaction and/or transaction price which is beyond control of Medtotes.
Note : All Terms and Conditions and Privacy Policy applicable to users are
equally binding for Service Providers.
